Terms and Conditions

Orders:

• By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions. If you are unhappy with any aspect of these terms, then you should contact Of Joy before placing an order with us by email at: enquiries@ofjoy.co.nz.
• By placing an order via this website you are making an offer to Of Joy to purchase the goods detailed in your order upon the terms described in your order.
• Once you have placed an order we will send you a confirmation that your order has been received.  This is not a confirmation that your offer to purchase the goods has been accepted. A contract between you and Of Joy for the sale of our products will only exist once an order has been accepted, processed and despatched to you.
• Once your order has been dispatched, the completion of the contract between Of Joy and yourself takes place. We cannot fulfil any obligations due to the following reasons:
• The product you ordered being unavailable from stock. 
•  Our inability to obtain authorisation for your payment.
• The identification of a pricing or product description error.
• Customers who fail to reach any order criteria set out in the Terms & Conditions.
• If there are any problems with your order, you will be contacted by a member of our team at Of Joy via email.
• We reserve the right to reject any offer of purchase by you at any time. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure but, in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

Product Pricing & descriptions:

• Each product purchased is sold subject to its product description. We will take reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the website as up to date as possible, the information, including product descriptions, appearing on this website at a particular time may not always reflect the position at the exact moment you place an order.

Payment:

• Payment for all orders is at point of despatch.
• The total cost of your order is the price of the products ordered plus cost of delivery.
• You confirm that the credit or debit card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.
• We reserve the right to withdraw any products from this website at any time and/or remove or edit any materials or content on this website.
• We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from this website whether or not that product has been sold.

To be eligible to purchase products on this website and lawfully enter into and form contracts on this website under law you must:

• Register by providing your real name, phone number, e-mail address, payment details and other requested information.
• Stipulate a delivery address.
• Possess a valid credit or debit card issued by a bank acceptable to our checkout provider (Stripe).

Postage:

• We plan to despatch our products within 2-5 working days of receiving your order. This is an estimate and could be shorter or longer than this time period. You will receive a confirmation e-mail once your order has been dispatched.
• We reserve the right to alter or change our delivery service at any time.

Returns and Cancellations

• Due to the nature of our products we do not accept returns. Any lost or late parcels or damage to our products during transit does not make Of Joy liable. Please read NZ post cover policy here.
• Any lollies melting due to warm weather during delivery once they have left our shop does not make Of Joy liable. To make delivery faster, order at the beginning of the week, to avoid delays over the weekend, however, this cannot always be guaranteed.
• Once the lollies have left the shop, we are no longer in control of how the postal service handles their parcels.

By accepting the Terms & Conditions, customers agree to read all our policies of sale prior to ordering our products at Of Joy. 

Privacy Policy

• At Of Joy we understand how important it is to keep your personal information private and secure online.
• When making an order with us, there are several personal details that we require including your name, postal address, contact number, email, phone number and bank account details. All your personal information will be completely confidential and will not be shared unless required by law.
• We do not store any card details and all our online payments are processed through Stripe.

Disclaimers

• Due to computer monitors and electrical devices displaying colours differently, the colours displayed of our products may differ from the actual products. Therefore, we cannot guarantee the colour seen online will be true in person.
• In relation to our craft and lolly suppliers, these can change over time, which again can cause a slight variation in the products shown in the images. This can cause a variation in the lollies, craft products and overall dimensions of the products. Sometimes we may be out of stock of a certain item where there may be temporary delays or discontinuation of an item. If this were to occur, we will replace the item with an item of the same value.
